I have a 5 year old son with Asperger's. At the beginning of school I was called in for a 504. I asked them how we get more accommedations for him (one on one) that I knew he would have to have. They told me he would have to be tested. However, they would have to observe for 60 days in order to even start the testing process. Demand a review for iep eligability. Bring any experts you think will help make your case they have 60 days to scedual a meeting. They will bring a principle/superintendant, special ed teacher (his special ed teacher not the head unless she will be working with your son), HIS teacher, speach therapist, ot, pt, and representative for any other service your son qualifies for.
Many schools like to give HFAs a 501 because it is easier and doesn't come with the legal hassles of an IEP. I would take these 2 months to read FROM EMOTIONS TO ADVOCACY by www.wrightslaw.com or another referance book with similar information on how to go about getting that first IEP. My district was good to me and when given the report of an autism dx they looked at his current therapist reports and agreed imediately on educational autism.

Does your county offer the child find program? That is where they do testing to find out where he is academically? Also your counties Department of Disabilities and Special Needs ( DDSN) can do the coordinating of services for him as we'll as perform their own test for your county. If you don't have a service coordinator then you need to call DDSN ASAP to have him signed up for services through them that way you don't have to do anything they take care of everything all you do is show up. The school is lying to you. IDEA 2004 is very clear that once the parent or school has identified a child that may need special education instruction then that testing must begin within 60 days of written request and consent. All you have to do is shoot an email to the staffing specialist in your school and request a full evaluation of your child and make sure in that letter you give them consent to begin the testing. Within 60 days of your request and consent the evals must begin. I can't believe the teacher told you your child needs 1 to 1, that is a big no no. You need to get her to put that in writing. You can use that in an IEP meeting as justification for your child to get a 1 to 1 paraprofessional for your child so he can stay in his gen ed classroom and still receive individual care. that is a win win. Your child with Asp. needs to be with typical kids so he can learn social skills as that will be his biggest hurdle. Don't let them move him into a self contained classroom as he will NEVER get what he needs in the way of social skills. Additionally, special education classrooms can pretty much use whatever curriculum they want so theoretically you child may be in the 5th grade doing kindergarten work. Fight for his gen ed placement with the proper support so he can access his specialized instruction.

I find out, I could record the school meeting...and I ran with it....I had to give them 72 hr notice and they to recorded it. There was a big change in the way some of them were quick to say no NOT having a clue only their own advise. I ended up receiving more doing that than the other way,..had been fighting over a year almost. No-one wanted their voice recorded so they ALL were very careful to say we don't..we aren't ,...etc. They first told me I couldn't record....but they found out I could. So they decided to let me...I repeated the persons name each time I answered them or ask them a question. I kept the recording. But my grandkids received a lot more help...I wasn't liked very much...But I wasn't running for a award. Also I made a appt and went in and copied ALL of his school records...so I could review them...by law you have that right. They can chg you for coping...but they didn't me. I find a lot of errors...where a lot of the things on his IEP were never accomplished and they just pushed it through and chged it with the nxt one...Our schools are a mess when it comes to children with special needs....just because a person is sweet or nice doesn't mean she is doing her job.
