My husband's daughter, diagnosed with Asperger's, lives in FL with her mother. She receives child support from us direct and she is getting SSI. His daughter will be 18 in September. She is trying to get additional child support from us to extend until she is 21. I don't know that laws in Florida, but I do work in child support division where I live. The laws are different when it comes to special needs children. If a doctor deems it necessary for a child to have extended care after the age of majority (which is either 18 and/or graduated high school). You need to take this matter to court to ensure that your son has what he needs because he has needs as well. You need to get medical documentation that states that your son has this diagnosis and has these needs, and your monthly cost to supply what he needs is this. If she is working and doing everything on her own, the mother will have a hard time proving why her daughter still needs child support. By no means make an agreement outside of the court. It will come back to haunt you. Check with a family law attorney in your area to make sure you are aware of what the laws are for special needs children because they are something that you need to know. I hope you continue to support your husband in making the right decision and hope that he thinks about your child as well in what he does next. Its not about picking and choosing which child needs more, but what is legally and morally right as well.

Well we dod some research and o am reading that the child being special needs must be in the text of the divorce decree or on a modification to it after. This is not in paperwork. Also sge can not file a motion 90 days vefore the child turns 18 and she will be 18 Sept. 9.
She also told my husvand ahe was going to ger guardianship over her but every OT she takes her too isnt dinding anything wrong with her.
I dont think his ex wife's case holds water..
