he literally was doing so good but because he was not offered esy he regressed over the summer and now has been showing agression the school had a iep where they basically said they didn't want to put in the work to get him back where he was and if his agression doesn't stop they will kick him out I am a low income mom and the other options I have will completely damage my son's future cuz he's very high functioning and extremely smart I feel like what there doing s so wrong cuz at the end of… read more

If the charter school is funded as a public school, then they need to follow IDEA law. Which means they can not expell him for behaviors due to his disability. You should reach out to the disability law center in your area for assistance.

All his behaviors are in his IEP they are still saying if the don't stop he will get kicked out it's a charter school

call an iep meeting. Get it documented in the IEP what his behaviors are. Don't let them know you are doing this. Once it's in the IEP, they can not expell him for behaviors that are because of his disability.

Read the book "From Emotions to Advocacy". Very powerful and helpful when dealing with school districts.

In reply to "HI I have a question". Every child is entitled to a free and appropriate education ..that is the law. The acronym is FAPE but i forgot what the P is for. You need to get an advocate--a person who specializes in assisting parents in IEP meetings and makes sure the school is on the up and up
.If the school where he s now is ill-prepared to educate your son, they must pay for him to get an education either at an Autism based school or a school with a specific autism curriculum/ and the school pays for transportation. Then, if the school fails to cooperate , you probably will need an attorney. Frankly, if i knew the school did not want to keep my child, I would prefer to have him in a different school, . and worry about inclusion later after he is able to get more services and help. A lot of the attorneys who deal with the education of special needs kids have a financial adviser on staff who can assist you in that way.Prayers and good luck to you.
