Taking Legal Action Against The School District

I am currently having an issue with getting the school district to allow ABA professionals to work with my son in school. State law in Florida dictates that parents can hire ABA therapists to work with their child in school and that the school has to allow it. My son's principle is the district director of special education and is refusing to allow my son, who has severe autism, to receive 1-1 ABA for more than 1 hour a day. Oh yes Florida, here we go, first make sure you got copy of the IEP with you that shows there scores the higher the better. Then whoever you get as your attorney which BTW make sure you get an attorney for special needs, The School can tell you know but remember this, and this will get you thru every fight NO CHILD LEFT BEHIND LAW gauranttees the school federal funds to get whatever means is needed to get your child the theraphy to learn. The FLorida Autism societyy is also a big help. I was in a heated battle with Orange County Schools they eventually backed down but after the year of tourture. My son qualified for the Mckay scholarship and we went the private school route which is another story in itself.. All in all 7 schools later we finally found the right one for him it took some heated disccusion with insurance but he is finally in a good school and doing incrediable.

@A MyAutismTeam Member, I never did, but wanted to. Advice, make sure you really want this, because it requires a lot of time. I know many that have gone this route, and the mental anguish/time/energy used for the lawsuit seemed insane. Just know that ABA can come to your home, they came to mine, for 5 years. Best of luck!

A special Education lawyer is trying to help us get transportation covered for a non school private therapy center. Therapeutic placement is not working out for him. He is ahead of his class.He is not ready for the districts less restrict high functioning program. If we do not get this covered, because the district is not required, we are going to do it on our own for a while.

yes, we hired a special ed lawyer after months of trying to get this principal (who has a special needs kiddo of his own) to understand our son's issues stemmed from ASD and he couldn't punitively punish him. It took 2 months of meetings, emergency IEP meetings and a final meltdown in front of the school psychologist and superintendent when they agreed to our terms and requests. One thing I learned was keep all your documentation, if you are on the phone with a staff member, memorialize it in an email and reiterate what you spoke about and lastly it won't be easy but push through it. It'll be worth it in the end.
