Jaxson attended K5. he was transported to the school and they accepted him in their zone last year. this year they said he can't attend due to their classes are full with local students. Just got the letter today about this. School starts on August 12. What is his legal rights as to going to that school again this year.

thanks, we got him in a much smaller school and they seem to be working with him a lot better than the other school. Our nearest school for special needs is 50 miles away. Which we would love to take him there but we got to be real on the time of waking him up and the travel for him twice a day. I tried to get my former daughter in-law to argue for him to remain at the school he went to last year - but.

I'm not a lawyer, but if he is on an IEP, the IEP team needs to determine placement. If his IEP calls for this specific school, and/or if there isn't another suitable school for him, you might have an argument to keep him at his current placement. Good luck!
