I have requested an IEE and the district never gave me info regarding criteria or their "approved" evaluators so I found my own and scheduled an appointment since the end of the year is fast approaching. The district is now saying they refuse to pay for it because the doctor will not send his credentials over and said that he has never been asked that by a district in the 15 years he has been doing educational evaluations. Can the district refuse to pay based on that?
Sorry I meant approve it or file for due process based on IDEA
They tried to deny it saying the school did not evaluate him for ASD so I had no grounds to disagree but I proved he was supposed to be evaluated for ASD so they agreed to the IEE until the doctor wouldn't send his curriculum vitae. He sent over his licensing info and practice info. I emailed the head of special Ed and told him he had to either approve it or deny it based on section 300.502 of IDEA. He has not responded but he only contacts me when he thinks he can get out of the IEE so I took all of my complaints to the superintendent yesterday afternoon and the head of special Ed for the county.
Did they ever approve or deny your request? If it was denied they have to send you Prior Written notice explaining why. By law when you request a IEE they have 2 choices- approve it or file for due process. How long has it been?
Then call the local university disability law center
