Late IEP Meeting

My son attends a brand new charter school that opened this past fall. He should have his annual IEP meeting in February. I have talked to another parent who's son was supposed to have his IEP last November. It still hasn't happened and we are now in January. Our boys are 9th graders. My son entered this charter with no transition meeting etc...I'm concerned that my sons IEP meeting will be "late"..,,, my question is...is there any law or rule about IEP meetings not happening when they should… read more

The law says the IEP needs to be reviewed at least annually, and more often if necessary. So it must be reviewed 364 days after it was written. If a school does not do this they are out of compliance and can be taken due process.

Yes if you request a meeting in writing they have 30-45 days depending on the district to comply, so I would do that and make them aware that you know your rights. That being said you may want to look into it with your state because if charter schools are considered private they have different rules. Just like any other school if you just let them make excuses and put you off they will. If they can get away with holding off services they will do that to

The parent can call for an IEP meeting at any time (put the request in writing), and the school must respond to your request with a proposed date/time within a certain number of days (10?) and hold it by a certain date after the request (45?) I don't remember the specifics but if you look up your state ed code it should be in there.
