My son is 19, he has aspergers. We live in Maine. He owns his own business. He often takes deposits with no understanding of the importance of using the money for its designated purpose. We're running out of money to cover his poor judgement. We would like Power of Attorney
Thank you
I suggest calling probate court to ask what conditions must exist to request power of attorney, or and legal guardianship, to protect the individual from self-harm, financial harm, legal harm,
Thank you,
I was reading up on guardianship and I think that is the route we're going to take. We understand it's expensive, but this last deposit episode was $13,000. Thanks again, Clamma
POA only lets you make decisions on his behalf but he can still do it as well, so if he isn't on board with you you may have issues. If you want full control you would need to try to get guardianship but that is a court process where you have to prove he is not able to do things on his own. Unfortunately this is not an easy process. Others might be able to tell you how it went for them, I just know it is not a quick easy thing.
