Live In An Apartment And Someone Is Complaining, What Do I Do?
A MyAutismTeam Member asked a question 💭

I have a question and might need some guidance. I moved into an apartment almost 2 years ago with my Autistic granddaughter. The managers knew I had a child like her and they were ok with it. I have never had a problem until two weeks ago when someone moved in below me and starting complaining about the bird feeders and I took care of that right away and yesterday she started complaining about the screaming fits and stomping (it does not happen everyday) but with School in and things have… read more

They cannot kick you out for that, and I agree the ADA will make sure that does not happen. I would talk to the management company or landlord and head it off at the pass. Make sure you tell them you will go to the ADA if they try something

Write a note to the newbie explaining she has a disability and that is why... thanks for their understanding. It is possible that will take care of it but I wouldn't count on that. Write the owner as well. In this letter tell what issue you are having, mention the screaming being part of your grandchild's disability, and that due to YOUR disability you cannot always hear like you stated here. Thank them for understanding that you are doing what you can to be a good neighbor and are just trying to live your life. Keep copies.
If it comes to it you can take the copies as part of your case to the civil rights office. As long as your landlord has a certain number of rental units the ADA covers you and I am betting you will not have to move. My advice overall is to stand your ground. And establish a paper trail.
You have rights. I am a firm believer in exercising those rights when and if necessary. Hope this helps. I wish you the best of luck!

I think if you go to that person and explain a little about what's going on she should understand and be companionate about it if not we'll let her know that you're within your right.

The Americans with Disabilities Act should protect you from getting evicted due to your granddaughter's disability. http://portal.hud.gov/hudportal/HUD?src=/progra...

Angel - how did it work out for you? I am having a similar situation at my apartment...single mom and stressed beyond belief whether we will have a place to live or not. My son is 15 is 190 pounds. He never causes damage to apartment, but might cry for 5 minutes or stomp his feet a couple of times. He usually calms down within 5 minutes and it is never past 9 pm that this happens as he is asleep in bed at that point.

The neighbor complained to me and I tried to explain situation...just worried I will be hearing from landlord soon.
